Do I need to buy or rent property under MM2H?
Yes. If you are applying under the three-tier MM2H or MM2H in SEZ/SFZ programmes, you are required to purchase residential property in Peninsular Malaysia within 12 months from the date your first MM2H visa is issued.
Failure to comply may result in the revocation of your MM2H visa.
This rule does not apply to existing MM2H holders who applied under the previous MM2H conditions.
What should I do if I want to buy property?
As land ownership is regulated by state law, it is advisable to engage a local solicitor to guide you through the property purchase process.
Before making any deposit, ask the solicitor to verify local rules and regulations for MM2H property purchases.
For MM2H holders in SEZ/SFZ areas, properties must be purchased directly from developers, not from agents or homeowners. Property prices may also require approval from the State Authority.
Can I buy land or commercial properties?
Yes, but this is subject to state laws. Always confirm with a local solicitor before placing any deposit.
Residential properties with commercial titles may be used for partial withdrawals from your MM2H fixed deposit. However, land, shop lots and office spaces are not eligible.
The main applicant’s name must be on the property title. Trusts or companies owned by the applicant do not qualify.
Can the property be jointly owned with dependents?
Yes. OSC MM2H allows joint ownership, provided the dependents’ names in the Sale and Purchase Agreement are also listed in the MM2H Approval Letter.
When does the 10-year locking period start?
The 10-year locking period starts from the first MM2H visa issue date, not from the property purchase date or SPA signing date.
